Location Tracking & Employer Responsibility

Geolocation Services and Employer Compliance

The GigaSphere platform provides features that allow subscribing employers ("Employers") to utilize geographic verification for employee clock in and clock out events. If Employer activates location based features, Employer acknowledges and agrees to the following:

  • Strict Boundary Constraints: GigaSphere strictly enforces a "Zero Background Tracking" policy. The application only captures a single GPS coordinate snapshot at the exact moment an end user actively triggers a clock in or clock out event. GigaSphere does not continuously track or monitor user location in the background.
  • Employer as Data Controller: Employer is solely responsible for determining whether the use of geolocation tracking complies with applicable local, provincial, state, or federal labor laws, privacy regulations, and collective bargaining agreements in their jurisdiction.
  • Consent and Notification: Employer represents and warrants that it has obtained all necessary disclosures, consents, and authorizations from its employees or independent contractors prior to enabling geolocation features. Employer agrees to clearly inform end users that a location snapshot will be taken upon clock in and clock out.
  • Indemnification: Employer agrees to defend, indemnify, and hold harmless GigaSphere from and against any claims, damages, liabilities, or legal disputes arising from Employer's failure to secure proper employee consent or any violation of privacy laws related to the use of GigaSphere's location verification features.
  • Manual Entry Fallback: If an end user disables location permissions at the device level, the GigaSphere application will default to manual text entry time logging. Management of compliance or disciplinary action regarding an employee's refusal to share location data is strictly an internal workforce policy matter for the Employer.
